Forbes assessed the consequences of Tinkov’s conflict with Nemagia for his financial condition. Sokolovsky’s lawyer about Tinkov and Nemagia: “All this is reminiscent of the situation with my client. The conflict between Nemagia and Oleg Tinkov lasted from the beginning of August to September

On September 18, the first pre-trial hearing on the claims of Tinkoff Bank against the authors of the YouTube channel Nemagia was held, and on the 19th an inquiry procedure was scheduled for Alexey Pskovitin, one of the two Kemerovo video bloggers.

This is the first time in the history of Runet that apolitical bloggers are being searched on charges of libel. Previously, this only happened to politician Alexei Navalny. And the most incredible thing is that because of rudeness and rudeness, one of the main rude people in Russian business, Oleg Tinkov, is suing them.

Secret's interlocutors at Tinkoff Bank say that its founder “cannot calm down yet.” He himself did not answer the editor’s questions. Today, Tinkov’s representatives announced that they would seek compensation for moral damages in the amount of 500,000 rubles.

Videos dedicated to the scandal have already been watched by more than 10 million people. As Tinkov himself wittily noted, it’s time to rename the “Streisand effect” to the “Tinkov effect.”

The Secret restored the full chronicle of the conflict and learned from experts in the field of PR and SMM why it is dangerous for Tinkoff Bank.

Banker Oleg Tinkov publishes a video on YouTube in which he tells how he tried to persuade video blogger Amiran Sardarov, author of the popular channel “Diary of a Khach,” to advertise Tinkoff Bank: “I just didn’t let him (Amiran Sardarov - Note) paid what he asked. Of course, all bloggers are corrupt. It is obvious. Only fairy tales are told..."

Maxim Shevchenko complained to Putin that “the guys from Kemerovo made fun of one oligarch, and a task force flew out from Moscow to them.” He added that this does not happen in ordinary civil lawsuits.

“A priori, we consider the actions of the police to be adequate and correct,” Oleg Tinkov’s lawyer commented on the departure of Moscow police to Kemerovo in the Nemagiya case. According to the lawyer, what surprised HRC member Maxim Shevchenko and President Putin did not raise any questions for Oleg Tinkov. Earlier, the story of a banker’s lawsuit against bloggers became the subject of discussion at a meeting of the Human Rights Council.

Maxim Shevchenko complained to the president that “the guys from Kemerovo ridiculed one oligarch, and a task force flew out from Moscow to them.” Shevchenko added that this does not happen with ordinary civil lawsuits. Vladimir Putin commented on what he heard with the word “disgrace,” but clarified that he was not aware of the details and the situation needed to be sorted out.

The visit of the capital's police to Kemerovo in connection with a libel case surprised not only Maxim Shevchenko and the president. Independent lawyers interviewed by Business FM also say that in practice this is difficult to imagine. According to the former senior investigator for particularly important cases under the USSR Prosecutor General, honorary lawyer Vladimir Kalinichenko, even large regional entrepreneurs who manage to obtain a personal reception from the head of the ICR, Alexander Bastrykin, cannot always count on such zeal from law enforcement officers:

Vladimir Kalinichenkoformer senior investigator for particularly important cases under the USSR Prosecutor General, honorary lawyer“He receives them, listens to them, and imposes a weighty resolution on their written complaints. People are happy, return to their place, local prosecutors and Bastrykin’s subordinates call them and say: “Well, you’ll complain to Moscow.” This is approximately the appeal. That is: “Don’t complain anywhere.” When a person comes here and gets an appointment not with Bastrykin, but with his deputy, they answer him: “Well, as you wish, we will never have enough workers to send people to the place based on your complaint to check the arguments that you have stated in your complaints.” And this is a big business, and the person in the region is far from the last.”

The situation with a libel claim in this context looks especially surprising. The question of whether Oleg Tinkov asked any of his acquaintances for help in legal disputes with bloggers, and if so, whether these people were connected with the law enforcement system, the banker’s official representatives considered it incorrect and did not answer it. Nevertheless, Tinkov’s lawyer Viktor Petrov still clarified that the operatives from Petrovka did not fly to Kemerovo for a civil lawsuit:

Victor Petrov lawyer of Oleg Tinkov“The task force and any operational investigative activities were carried out not in a civil suit, but in a criminal case. This is an important mistake that was made by Mr. Shevchenko at the meeting. Regarding why this was done: Oleg Tinkov does not control the work of law enforcement agencies. It’s quite difficult to comment on surprise, because we a priori believe that any investigative measures carried out by the police are adequate and correct, since they are professionals doing their job.”

Is there any threat to professionals for such work? It’s unlikely, says lawyer Suren Avanesyan:

Advocate “Can police officers from Moscow go to Kemerovo to carry out any actions? Answer: formally yes, they can. Question: does this happen often? Answer: with such compositions this practically does not happen. The question is: can they be held accountable for this? Answer: all other things being equal, it is quite difficult to hold people accountable, since this action, in my opinion, is within the scope of their powers. Under what conditions can they be held accountable if there were some kind of agreements and some kind of motivation of employees? If one of the employees says that yes, they were motivated accordingly, or there is some other evidence of personal interest, only in this case are some adverse consequences possible both for the performers themselves and for the customer.”

Presidential press secretary Dmitry Peskov clarified that so far there have been no instructions regarding the Nemagiya case. The case itself has not yet been closed. Oleg Tinkov’s lawyer told Business FM that the banker did everything to close this criminal proceeding. According to Viktor Petrov, now bloggers should write a statement of reconciliation, and then everyone will be happy. However, YouTube stars do not want reconciliation, says their lawyer Alexander Zinurov:

Alexander ZinurovNemagia lawyer“They consider themselves innocent. And they say: “Alexander, you must prove our innocence, our non-involvement.” “I understand,” I say, “I will act.” If the investigator is ready to terminate the criminal case due to the lack of corpus delicti in their actions, we are not against it! Oleg Yuryevich, as far as I understand, he wants to stop it for the reconciliation of the parties. And this is a non-rehabilitating basis, this is that they must admit guilt: yes, we slandered, we are guilty, but let’s stop, because we have reconciled. But they don't want it that way. I can't influence this in any way, unfortunately. I am only fulfilling the will of my principals.”

Meanwhile, Alexander Zinurov’s clients continue to make videos about the conflict with Tinkov. The one published two weeks ago has more than a million views, the previous one has 2.5 million. But why did Maxim Shevchenko suddenly remember about this story? In the media space, the conflict has essentially died down. Here is what Maxim Shevchenko himself says about this:

Head of the Center for Strategic Studies of Religion and Politics of the Modern World“It died down, but at the same time the lawsuit against the guys has not been stopped. The trial is underway, they are threatened with persecution. Tinkov tried, as they say, to transfer the conflict with the help of PR technologies to a certain level of attenuation, but there is no attenuation at all. I respect the guys from Nemagiya and consider them very talented, brave journalists. And, having studied this issue, I decided to stand up for them. Somewhere a few days before the meeting, I made a video on my YouTube channel about the conflict between Tinkov and Nemagia.

This video by a beginner, but obviously ambitious video blogger Maxim Shevchenko, has received 36 thousand views. The channel itself, created on October 18, has 8.5 thousand subscribers. It’s interesting how quickly these figures will begin to grow after the author, in front of the president, stood up for bloggers in front of cameras, to whose resources a total of more than 2.5 million people are subscribed.

On September 5, in a confrontation between YouTube bloggers Nemagia and Oleg Tinkov, Pavel Durov called for distributing a video about Tinkoff Bank until it was removed by decision of Roskomnadzor. The businessman told him on September 6, recalling a hit-and-run with a police officer in 2013.

The founder of Telegram has not had a good relationship with the head of a credit institution since the start of work on VKontakte. TJ compiled a public history of their conflict.

Some posts have been lightly edited for easier reading.

year 2009

In December, Oleg Tinkov opened an official account on VKontakte, but immediately doubted whether he had done the right thing.

It was then that Tinkov first noted that Durov refused to come to him for an interview. The Internet program of the head of the bank, “Business Secrets,” whose guests were mainly entrepreneurs, was already in its third month by that time.

Today our director of product and marketing Artyom Yamanov came to me and said that this sucks, and there is the wrong target audience for me. He said that you need to start a Facebook, is that true?

In fact, I can say one thing: sooner or later, all projects in RuNet “die”: “Odnoklassniki”, Damochka and so on, now “VKontakte”. And what’s fresh always attracts – Twitter, Facebook.

And the fact that the founder of VKontakte Durov did not respond to any of my emails makes me wonder: is the founder a bad manager or just an ill-mannered person? I could, like others, write, saying, I don’t give interviews.

Oleg Tinkov

At the end of December, the vice president of Tinkoff Bank and co-host of Oleg Tinkov, Oleg Anisimov, wrote to a viewer that Durov did not respond to invitations to come on the show.

We wrote to Pavel Durov, but he did not answer.

2010

In November, the banker spoke about a weekend in St. Petersburg and a personal meeting with the founder of VKontakte. Tinkov assured that “Business Secrets” with Durov will still take place.

Then we went to hang out at the Begemot bar, where the founder of VKontakte, Pavel Durov, came up to see us. After our online acquaintance a few hours before.

Here's an example of technology: we met and communicated via Twitter. I really liked and impressed Pavel, although, as in the movie “The Social Network,” I (Mark and Sean) did most of the talking.

There will be a transfer for you with him! I hope we will do it in the New Year, or a little later. He and Ilya [Perekopsky] left. Then there was a lot of champagne and I almost died.

I was offended that Durov did not respond to my emails, but it turned out that he did not read emails. We met and everything became clear. As always, I made a mountain out of a mountain.

2011

On May 1, Tinkov remembered Durov when he was upset by a poll on a St. Petersburg TV channel, according to which many Russians would like to go to the May Day demonstration like in the USSR.

I saw some movement today on Nevsky Prospekt, young people were walking back and forth. What did you want - what the **** [horseradish]? Go write programs like Pasha Durov. The scoop is unshakable - Putin is right.

Oleg Tinkov

Nowadays, when the main problem (after money) is loneliness, Dr. Zuckerberg, his Russian assistant Durov and other doctors have opened their own clinics for the treatment of souls. Loneliness has taken over the planet, people have built skyscrapers and don’t see each other, don’t communicate, they earn money from morning to night. When there is no one to call or even write to, you write a post.

Well, comments - and answers - are drugs. I wonder how long this psycho-social phenomenon will last. Will it become the collective unconscious, that is the question. Or am I captain obvious? Then I’ll delete the post, now delete [delete] is a simple thought.

Oleg Tinkov

In June, a small skirmish occurred on Twitter between Durov, VKontakte employees and Oleg Tinkov. It began with Durov’s answer to journalist Pavel Kushelev on message about "America - the big and main hundred."

Without you, we will not overcome this capitalist hydra. Thank you!

Pavel Durov

Without capitalism and [businessman Alisher] Usmanov, there would be no VKontakte and where would you be? There would be no Nevsky office and apartment on Krestovsky. Capital is freedom.

Oleg Tinkov

We joke about the “capitalist hydra,” of course. Nevertheless, freedom is within. Money is a means of improving the world.

Pavel Durov

Of course, I’m not perfect, I’m not Pavel Durov. I'm just like you all! [reference to his book]. Don't ask more from me.

Oleg Tinkov

In July Tinkov first through Twitter and then through Google+ condemned Durov’s response to Mail.Ru Group’s intentions to “absorb” the social network - then the founder of VKontakte published a photo with the middle finger, which later was deleted from his Instagram.

Fuck U said to [Chairman of the Board of Directors of Mail.Ru Group Yuri] Milner - this is from impotence. The boy became arrogant and lost. Pasha, you are weak to compete with our generation - the outcome is clear.

Oleg Tinkov

Durov became completely arrogant. Rudeness is already beginning, but this is due to impotence. Our little genius has gone down the drain, I think.

In my 25 years of business, I have seen dozens of such “stupid” people. Fledged early. This is how to talk to respected people and people who have done something, and not stupidly stolen the Western interface, or as Artemy Lebedev said - the logo from LinkedIn.

Yuri Milner, although strange too, is a global figure, he is reckoned with all over the world. And [St. Petersburg businessman, father of VKontakte co-founder Vyacheslav Mirilashvili, Mikhail] Mirilashvili Sr. will not help this boy as before.

Everything is clear with him, not because he has almost no shares left in the company he founded, but because he has “gone crazy” and believes that he is God and the coolest. Everything is the beginning of the end, believe me, an old and sick person. It's a pity, it could have ended better.

Oleg Tinkov

For Durov first answered his comrades-in-arms via social network.

Oleg behaves like an offended, corrupt woman both in business and on Twitter.

Ilya Perekopsky

Co-founder of VKontakte

You idiot, you don’t write your name twice in Twi. Go ahead, lick your “genius’s” ass, I’ve seen you promising in my time. The porn network is evil.

Oleg Tinkov

I, too, had not yet planned to work in a bank with the motto “we drink and spam.”

Uncle, take me to work! I'll drink with all your employees.

Vladislav Tsyplukhin

At that time, the press secretary of VKontakte

I thought that your duties included only carrying a towel for Tinkov. Hello, Oleg!

Vladislav Tsyplukhin

Oleg Tinkov is an excellent entrepreneur and a straightforward person, do not offend him.

Pavel Durov

After this, the skirmish ended, and Pavel Durov temporarily changed his Twitter nickname to Porn King (“porn king”) and added the same signature to his status on VKontakte. Soon Tinkov wrote about Durov on Google+.

Oleg Tinkov

Later Tinkov and Anisimov in detail explained, for which they don’t like VKontakte, and invited Durov to respond to their statement through “Business Secrets”. TJ publishes the text with abbreviations.

1. Pornography. We are not against pornography, but we are against it being placed in public places. VKontakte has a huge number of public videos and groups with obscene content. There are millions of users in these groups. The younger generation is no longer even ashamed. Their idol Pavel Durov considers the presence of such content normal for a social network.

2. Pirated content. We all admire actors and directors. But how will they make money if everything is available for free? Russia is a big market, but it is captured by piracy. VKontakte's policy encourages this.

3. Country reputation. The rampant pornography and illegal content on the largest social network allow us to talk about Russia as “Nigeria in the snow.” But that's not all. Mail.Ru Group is the largest shareholder of VKontakte, has more than 40% of the shares, the company recently held a successful IPO in London. What is Pavel Durov doing? Publicly sends the shareholder three letters.

We call on Pavel Durov, who determines the policy of the social network VKontakte, to make its rules civilized and socially safe. And monetization will come to it even without this. Today, when social networks are so overvalued, Pavel can earn more from capitalization than from the operating system.

If Durov has arguments against the above, we are ready to host him in our “Business Secrets” program in September and discuss it.

Statement by Oleg Tinkov and Oleg Anisimov

Durov did not react to the words of the head of Tinkoff Bank.

year 2013

On April 21, amid growing interest in VKontakte from United Capital Partners, the media reported that Durov flew to Buffalo and had no plans to return to Russia.

Before Durov and the social network’s press service denied these data, Tinkov said that he generally expected such an outcome. At the same time, the head of the bank for the first time publicly mentioned the collision of Durov’s car with a policeman in St. Petersburg.

Some idiots believe that someone there is squeezing out his [Durov’s] business. What is there to squeeze out, he has only 12%, and who needs him.

His partners sold the shares a week before he crushed the police. It's a pity, he's talented and could have finished better.

Remember, Pasha, I told you, you need a mentor like Sean Parker for Zuckerberg to stop your madness. Plus, here we are in Russia, it’s a little different here.

It seems that the conflict between Tinkoff and bloggers is over. As it became known, there were no statements from Tinkoff Bank regarding the trial with bloggers.

A month after the suspension of proceedings in the case of Tinkoff and the video bloggers, there is still no news. It seems that Tinkov decided to stop and not continue the proceedings to protect his business reputation.

Let us remember that at the same time, the banker tried to receive compensation in the amount of 500 thousand rubles from Kemerovo video stars. Mikhail Pechersky and Alexey Pskovitin commented on this situation occasionally, and after the publication of the court decision on the official website, many exhaled and stopped worrying about the future fate and creativity of the young people.

Details about the termination of the trial have not yet been published. But news appeared online that Oleg Tinkov and his credit institution withdrew their claims, which were filed with the Central District Court in Kemerovo.

The background of the story

The reason for Tinkov’s dissatisfaction, we recall, was a video that was posted on the Pechersky and Pskovitin channel. The channel is called Nemagia and specializes in producing parody videos.

The video about Tinkov contained an interview with the banker in which he talked about himself and his work at a financial institution. After this publication, a wave of dissatisfaction and indignation followed on the part of Tinkoff and, of course, a lawsuit in which the bank’s board demanded to remove the video material from the network, prohibit its distribution and reimburse 500,000 rubles as compensation for damage caused to the bank’s business reputation.

The whole country followed the development of events and waited impatiently to see how this story would end. But unexpectedly, Tinkov’s representatives made a statement in the Kemerovo court in the fall. The statement said that the claims were withdrawn and the case was dropped, because the principal “of his own free will” did not want to continue the lawsuit and demand financial penalties from the bloggers.

Withdrawal of the claim

No one began to talk about why Tinkov changed his opinion so abruptly. Even curious journalists, alas, failed to find out.

It is reported that Kemerovo court judge Elena Isakova terminated the proceedings in the case. At the same time, all measures taken during the trial have been cancelled.

As a result, Roskomnadzor unblocked the video, and it is now available for viewing and distribution. Tinkov, according to preliminary data, also withdrew the lawsuit filed earlier with the police against Pskovitin and Pechersky.

Rumors about the high-profile case even reached the head of state. The information was conveyed by none other than Maxim Shevchenko, a member of the Human Rights Council. He told Vladimir Putin about the controversial situation between bloggers from Kemerovo and the founder of Tinkoff Bank.

The capital's operational group in Kemerovo, without orders or court decisions, searched the house of the guys who posted the video about Tinkov. During the search, equipment was confiscated. Putin reacted sharply to such information, calling this behavior of the task force complete “lawlessness.”

Many believed that an official statement from Tinkov would appear online, in which he would explain the reasons for suspending the case. After all, previously the banker tried to stand up for himself, to protect his name and the name of his own financial institution.

After a while, it became clear that Oleg Tinkov was not going to make any comments, and the previously published video about him and the bank did not seem to bother him. The conflict brought benefits to both sides: Tinkoff Bank became even more popular, receiving free advertising, and the whole country learned about unknown bloggers.
